The Department of Justice was created by the Department of Justice Act, adopted during the first session of the Parliament of the Dominion of Canada and assented to on May 22, 1868. The Act defined the responsibilities of the Minister of Justice and the Attorney General of Canada, which have since remained essentially the same.

The objectives of the Department are to provide legal service to the Government of Canada, its departments and agencies; to oversee the administration of justice in Canada within its jurisdictional rights (outside provincial and territorial jurisdictions); and to initiate policies and programs which aim to promote an accessible, equitable, and efficient system of justice.
